Woman sues over request for video

A lawsuit has been filed on behalf of Yvette Hayes, a Kansas City woman who claims Independence Police officers racially profiled her.
The lawsuit accuses the Police Department of not answering Hayes' request for copies of dispatch audiotapes and video from police cameras.
Hayes, who is pregnant, was pulled over July 13 on Interstate 70 after police received a tip that she might have been driving a car similar to one connected with auto thefts around J.C. Penney, where Hayes was shopping with her children. Police determined Hayes was not a suspect and released her.
Police Department Public Information Officer Tom Gentry said the department has not been received any information regarding the lawsuit.
The police have released the video to the media.
Video of the stop comes from a police car's camera behind the car of officers demanding that Hayes get on the ground. Approximately a minute later they realize Hayes is pregnant. The officer directly behind Hayes' vehicle tells dispatch to note that his dash camera is not operating.
Police Chief Fred Mills said last week the video shows the officers conducting a routine felony traffic stop, and when they realize Hayes is not a suspect, they treat her properly. Mills said the officers showed compassion for Hayes and apologized to her. The incident is still under review.
A dash camera video and dispatch audio clips recorded during the stop of Yvette Hayes will be given to Hayes' attorney, Phil Klawhun, today.
Klawhun filed a petition in Jackson County Court Wednesday. "I called him (Klawhun) yesterday and left a message to see how they wanted it (the information) delivered," Independence City Counselor Allen Garner said.
Klawhun said the Police Department did not respond to his request for the video and audio within three days of his request for the information, pursuant Missouri's "Sunshine" law, even though the department showed the video to media and the National Association for the Advancement of Colored People.
Documents provided by Klawhun include a fax to Independence Police Department Chief Fred Mills requesting the information.
Klawhun was retained by Hayes and requested the information to investigate her claims of false imprisonment, false arrest and malicious prosecution, according to his letter to Mills dated July 18.
Klawhun confirmed the information he requested will be provided to him but did not say the lawsuit for failure to provide the information will be dropped. In the petition, Hayes and her attorney requested the defendant be compensated at least $1,000 from the department for attorney fees.
Garner said he had no comment, as he had not received an official copy of the petition, only one from a television station.
Even though he did not have a copy of the video, Klawuhn said he had seen portions of the video, which was released to media outlets throughout the Kansas City area. He refused to comment on what he saw.

According to the complaint filed by Hayes' attorney, she was ordered to throw her keys out the window of her car and lie on the ground. The complaint said J.C. Penney's security office reportedly informed Independence police Hayes' vehicle matched one involved in car thefts and break ins. But police later declared it was a different vehicle and that Hayes was not a suspect.
Hayes also made a formal complaint to the Police Department that is still under investigation.
