Topic: Sample Clearing.... Help a brutha out...

    I was looking for a possible vendor (CD Baby) to sell this upcoming project I'm working on and well...I used a lot of samples for it, and they want me to own the sample and/or clear them....and it's a pain in the butt to clear samples and pay royalties and all this other crap. And I sampled from relatively unknown people from like the 60's and 70's. So I'm wondering... ....to people that have used CD Baby, preferably.... [size=24:fe599fbf03]Is all of that sample clearing and stuff worth it or should I just wing it and try to sell it anyway.... WHAT SHOULD I DO????[/size:fe599fbf03]

    trust me, you can't afford to clear them. You'd need at least a couple thousand just to get the mechanical license...you'd still have to pay or get permission by the owner of the song. Plus the majority of labels out won't give sample clearance unless you are signed to a major. They figure that you probably don't have enough money to pay em.

    I used 100 samples making Dreamtime, and I haven't had a problem. Granted, some are freaked as fuck, but man, a lot aren't too. You'll be fine,as long as your average joe wont recognize, Id be interested to see if anyone could name any samples off Dreamtime, and how many they could name.

    ^yeah...I remember talkin with Anti crew when they dropped their mixtape...they sent it off to get burned, but since they used some mainstream beats, the company didn't do it. Not because they could recognize the samples used, they recognized the whole beat that they used...

If you got cats in other states, send them some copys & let them trick em off on the streets for you. For any underground/up & coming artist, having a street team is gonna be the best way to get your stuff out. You got people to vouch for your product/its the best & affordable way to market yourself/it's gives a more personal co-sign than just putting it in a store....... create a buzz in the street 1st..then head to the stores is my advise....

    naturally it would have to be someone you trust or if you have the means, take a weekend trip wit you & your crew to head out of state & do it your self. I've found that people tend to respond more to out of towners doin their thing cuz it shows them that you are making serious moves & they are intrigued as to why you chose their town to come to.....

    Most pressing houses and online distributors will ask if you have appropriate clearances for any samples that may have been used, but few of them follow through and enforce those rules.

    depends on how big the sample is & if its recognizable. When i was with UKUEPTO, one of the producers in the group sampled all the time, but he rearranged it so much until it was completley unidentifiable from the original. He would also take bits & pieces of tv shows & commercials.. you know stuff that most people wouldnt be able to recognize anyway & we were able to get all of it copyrighted. my general rule of thumb was, we are not no big time group & anybody who came after us for sampling their joint knew it would be a waste of time, they would wind up spending more money in lawyer fee's then they would actually win.... doubt if that explanation would hold firm in a court of law but thats my rationale & Im stickin 2 it......:)

    I have someone who said they would be willing to publish me joints on their site, which is represented in part by, BMI. but I either had to eliminate my samples or get permission. This is what is holding me back from "signing" a distribution contract. They want to make sure that even the samples that i used that are "royalty free" are truly that. I thought I could just hop on. But its no joke. If people feel like they have lost any profit, they will most likely, not always, but still way too frequently, seek legal action. Then at the same time, I still produce melodies that I have actually played and been told that htey sound all of Professional, MIDI :wink:, and like a video game. You gotta take chances though thats what keeps HIP HOP fun. everything you do wont be perfect. Shit I got tracks I think are J. Blaze. I bump em err day. but they dont get any love on the sites or boards. you gotta go for yours and be selfish about it. do it for yourself. you got mad talent. my humble opinion.     I have been making music on coleco vision music (commadore 64) WAY back in '86 - '87. We were recreating Run DMC beats, we thought we were fresh. I have tried alot of different music programs. If you look, you can get some really good sounds, loops, and instruments. I got a little frustrated when I came on this board and found out how many people use MPC's. But then I found that my MIDI controller and a certain program act the same as having an MPC, it was all good. Plus I have an ancient Gemini DS-1224 Sampler. I'm glad that I have the ability to create chords and melodies without sampling though. Sampling sounds cleaner...most times.but its good to have something to fall back on. good luck mane Peace AF

I ain't gonna front, I use FL Studio (with like 5 other minor programs ) and it suits me just fine..... Shoot... give me a VCR, Some duct Tape, a Chicken bone,and a microphone..I still make a beat..... NAWW MEAN!!!!

    Why wouldn't you get an mpc if you had a million dollars? who said you can ONLY use an Mpc exclusively after you buy one? I mean, I use a hammer, but I'm not opposed to other equipment. I tried using an mpc 2000xl once, but it's not as sturdy as my anvil and it broke. 😥

But is seems as though my plan didn't work the best.... I would mos def get an MPC even if I had 10,000 bucks.....     Don't worry about clearing samples man. Just press your shit up and put it out. They aren't gonna fuck with you until you're worth fucking with (meaning they can sue you.) And when you get to the point that you're worth being sued by a big label (money wise I mean, not talent-wise), you'll know the game well enough. Jack whatever you fuckin' want.
